Course Outline

This 3-day course combines storytelling with lecture-style presentation, experiential learning and interactive exercises. Explore the fundamental skills every investigator needs to know through 7 modules:

MODULE 1: PRINCIPLES OF REGULATORY INVESTIGATIONS

This module focuses on the key principles of who we are as investigators and the components of a properly conducted investigation. This module includes an overview of the regulatory system as well as ethical, legal and regulatory considerations within investigations.

MODULE 2: PLANNING THE INVESTIGATION

A well-planned investigation is a well-executed investigation. This module teaches a framework for planning investigations and how to utilize investigation plans as a living organizational tool to ensure no steps are missed and no unnecessary steps taken.

MODULE 3: EVIDENCE COLLECTION

This module examines various methods for collecting evidence and the factors to consider. It includes an in-depth review of best practices for each evidence collection method and troubleshooting tips for challenges that may arise as well as facilitated group work to enhance learning.

MODULE 4: INTERVIEWING

Investigative interviewing is both an art and a science. This module explores how to identify and select witnesses, how to effectively prepare for an interview and strategies to produce thorough yet efficient interviews. This module also provides opportunities to develop and practice effective interview skills in small groups.

MODULE 5: NOTE-TAKING & REPORTING

This module covers the fundamentals of writing clear, concise, and complete reports and memorandums as well as best practices for clear and accurate note-taking.

MODULE 6: CONFLICT MANAGEMENT

Conflict is a common occurrence in regulatory investigations; effectively navigating conflict is crucial for successful outcomes. This module will explore various conflict management styles and apply conflict management approaches to real scenarios that can arise throughout the investigation.

MODULE 7: MANAGING BIAS

Unconscious biases are powerful and risk influencing investigations without proper management. This module will review common biases, explore the science behind bias and outline strategies to mitigate our own biases to produce neutral, unbiased investigations.

Greg brings a wealth of investigative expertise to professional regulators. For more than 15 years, Greg has worked closely with professional regulators across Canada while conducting methodical, objective and balanced investigations. Greg provides investigative training and workshops to professional regulators, and regularly speaks at conferences and continuing professional education events. He works closely with regulators to ensure their employees have the training, skill and support needed to bring meaningful conclusions to investigations handled internally. He also assists regulators to develop investigation policy and process. Greg is also deeply focused on building Barker Hutchinson’s sophisticated team of investigators and ensuring they have the training, skill and support necessary to produce fair, focused, efficient investigations.

Alex Saul

Manager of Investigations

Alex is a highly strategic investigator whose work is grounded in an empathetic, trauma-informed practice. As a Manager of Investigations, Alex provides strategic oversight of Barker Hutchinson’s regulatory investigations in addition to maintaining her own smaller caseload. Before joining Barker Hutchinson, Alex practised as a registered nurse, with a focus on mental health, and she worked as an investigator with the College of Physicians and Surgeons of Ontario. She is committed to a rigorous search for clarity and fairness in each investigation.

Laura Hutchinson

Co-CEO

Laura is passionate about all things investigation and focused on training and mentoring Barker Hutchinson’s sophisticated team of investigators. Laura is a natural educator and communicator. She enjoys connecting with regulators and investigators and helping them improve their skill and expertise, whether through providing training and workshops for professional regulators or sharing her experience at conferences and events. Laura also assists regulators with the development of investigation policy and process. Laura has investigated a wide range of regulatory concerns for professional regulators across Canada. Laura’s years of experience as a regulatory investigator coupled with her extensive health care knowledge and practical experience as a regulated health professional have honed her ability to bring clarity to complex investigations. Laura holds a Masters of Science degree and practised as a physiotherapist prior to joining Barker Hutchinson.

Lonny Rosen

Lonny Rosen is a founding partner of the Toronto, Ontario health and regulatory law firm Rosen Sunshine LLP. He has been certified by the Law Society of Ontario as a Specialist in Health Law. Lonny advises on a wide variety of health and regulatory law issues. His clients include health care professionals, regulators, administrators of health care facilities, professional associations, and individuals. He represents clients in a range of civil and administrative proceedings, including in complaint and discipline matters, investigations, audits and peer reviews, hospital privileges disputes and in hearings before various health tribunals. He also advises professional regulators and serves as independent legal counsel to their Discipline Committees. From 2012 – 2022, Lonny was a Senior Lawyer Member of the Consent and Capacity Board. He has served as Chair of both the OBA and CBA Health Law Sections and was a Director of The Advocates’ Society. He is a member of the governing council of the Medico-Legal Society of Toronto. He frequently writes and speaks on health law issues and is an Adjunct Professor of Osgoode Hall Law School, teaching Health Law. In June 2016, Lonny was named the inaugural recipient of the OBA Susan Hilary Davidson Memorial Award for Excellence in Health Law. Lonny was included in the Canadian Legal Lexpert Directory as “Repeatedly Recommended” for Life Sciences & Health and “Consistently Recommended” for Professional Liability. Richard Steinecke

Richard Steinecke (he/him), practised professional regulation law with enthusiasm until his retirement in 2022. Because of its comprehensive nature, courts and tribunals have cited his book “A Complete Guide to the Regulated Health Professions Act” dozens of times, even in cases dealing with non-health professions. He still updates his book twice a year. He continues to read, write, and teach about professional regulation. In 2015 he received the Regulatory Excellence award from the Council on Licensure, Enforcement and Regulation (CLEAR) and in 2019 he received the Tom Marshall Award of Excellence for the Public Sector from the Ontario Bar Association. He has written three crime novels related to professional regulation: Disgraceful, Dishonourable, Unprofessional; Conduct Unbecoming; and Ungovernable.

Elyse Sunshine

Elyse Sunshine is a founding partner of the Toronto Health and Regulatory Law firm Rosen Sunshine LLP. Elyse was called to the Ontario Bar in 1999 after receiving her LL.B. from the University of Western Ontario Law School in 1997. Elyse serves as independent legal counsel to various regulatory bodies and in that regard, assists the discipline committee, fitness to practise committee and registration appeals committee. Elyse also assists health care professionals, health associations and organizations by providing advice and opinions with respect to privacy, regulatory, administrative and civil matters. Elyse frequently assists organizations (such as professional associations or quasi-regulatory bodies) and health facilities (including health centers, clinics and private practices) with a review of their existing or development of new privacy practices and policies, taking both a practical and efficient approach. In addition, Elyse regularly provides opinions and general advice to individuals and organizations, such as associations of health care professionals.
